1. Scope and contractual service provider
1.1 Services covered by these terms. These General Terms and Conditions apply to chauffeur and passenger transport services provided by Ferdi Gökce, trading as FEGO Executive Mobility, referred to below as “FEGO”. They cover, in particular, airport and other transfers, hourly bookings, event transport and multi-day assignments with a chauffeur. They apply to both private and business customers.
1.2 Terms applicable to an individual booking. The agreed quotation and booking confirmation determine the nature and scope of the service owed. Individually agreed terms take precedence over these General Terms and Conditions. Mandatory statutory transport and tariff rules remain unaffected. These terms do not govern standalone concierge, intermediary or travel services.
1.3 Customer terms. Any different terms and conditions of the customer apply only if their inclusion has been expressly agreed with FEGO. Individually agreed terms continue to take precedence in this respect as well.
2. Enquiries, quotations and binding bookings
2.1 Enquiries and quotations. An enquiry through the website, by email or by telephone is initially non-binding. FEGO then prepares a quotation, specifying in particular the proposed journey details, scope of service, vehicle category, price and payment terms. For hourly or multi-day bookings, it also specifies the included time and mileage and the applicable rates for additional services.
2.2 When the contract is formed. By placing an order based on the quotation, the customer submits a binding booking request. The contract is formed when FEGO expressly confirms the booking and the customer receives that confirmation, for example by email. An automated acknowledgement of an enquiry or booking merely confirms its receipt; it does not constitute acceptance of the order.
2.3 Provision of these terms. Before the customer makes a binding booking, FEGO provides these terms with the quotation or in another form that can be saved. They are agreed when the contract is formed. The customer is asked to check the journey details in the confirmation and promptly report any apparent discrepancies. This does not restrict statutory rights.
2.4 Changes to an existing booking. Changes to the collection time, collection or destination address, route, vehicle category, passenger numbers, duration or other aspects of the service are coordinated with FEGO. Their implementation depends on available capacity and operational and legal feasibility. Before the customer orders a change, FEGO provides the additional price or its basis of calculation. If no change is agreed, the original booking remains in place; statutory rights and the cancellation options in clause 8 remain unaffected.
3. Services, vehicles and partner companies
3.1 Included services. The agreed fare includes the chauffeur, fuel and the vehicle’s travel from and back to the depot. The chauffeur wears business attire. Drinking water is provided in saloons and vans. Wi-Fi is offered where technically available; an uninterrupted connection cannot be guaranteed, particularly because of mobile network coverage.
3.2 Transfers and personal collection. A transfer covers the agreed transport from the collection point to the destination, including confirmed intermediate stops and the complimentary waiting time described in clause 5. For airport collections, the chauffeur personally welcomes guests at the agreed, accessible meeting point in the arrivals area. Airport access restrictions must be observed.
3.3 Hourly bookings and multi-day assignments. For an hourly booking, the vehicle and chauffeur are available for the booked period within the agreed scope. Driving, waiting and agreed standby time within that period count towards the booked duration. The period starts and ends at the agreed location; travel from and back to the depot counts towards the booked duration only if expressly agreed in the quotation. For multi-day assignments, the quotation specifies the individual operating windows, included hours and mileage, and standby periods.
3.4 Vehicle category and capacity. FEGO will provide a vehicle in the booked category with the agreed passenger and luggage capacity. A specific model, colour or individual vehicle is binding only if expressly promised by FEGO. An equivalent vehicle within the agreed category may be used. If the agreed service is unavailable, FEGO coordinates a suitable solution with the customer; a substitute that is not equivalent does not become the agreed service without the customer’s consent.
3.5 Use of partner companies. FEGO may engage carefully selected partner companies whose suitability has been checked to perform the service. FEGO remains the customer’s contractual service provider and remains responsible for proper performance in accordance with statutory provisions. The customer is not required to first pursue claims under their contract with FEGO against a partner company.
4. Prices and charges for additional services
4.1 Agreed price. The agreed quotation price applies to the booking. Prices quoted to consumers include statutory VAT. Quotations to business customers may expressly state net prices plus separately shown VAT. No surcharge is applied solely because a journey takes place at night, at a weekend or on a public holiday.
4.2 Additional time and mileage. Before the contract is formed, the quotation specifies the rates for the booked vehicle category for additional hours, additional mileage, waiting time and other services, together with the applicable billing intervals. Additional charges arise only on an agreed basis. For changes ordered later, the customer is informed of the additional costs before ordering the change.
4.3 No duplicate time charges. The same period is not charged both as additional waiting time and as additional booked time. Waiting within a paid hourly booking is already covered by that booking. Time and mileage charges may apply alongside one another where the quotation treats them as separate components of the service; the same kilometre or service is not charged twice.
5. Collection, waiting times and flight changes
5.1 Complimentary waiting time for transfers
The waiting times below are included in the fare for transfer collections. They allow, in particular, for the usual steps involved in reaching the vehicle. Clause 5.5 also applies to hourly bookings.
| Collection | Included | Waiting time starts at |
|---|---|---|
| Airport, scheduled flight | 45 minutes | Actual landing |
| Airport, private flight | 30 minutes | Actual landing |
| Other collection addresses, e.g. hotel, private address or office | 15 minutes | Agreed collection time |
If a collection time later than landing has been expressly agreed for an airport collection, complimentary waiting time starts at that agreed time. For private flights, the agreed, actually accessible terminal area is the meeting point.
5.2 Flight number and updates. The customer provides the correct flight number and informs FEGO as early as possible about changes, rebookings or a cancelled flight. Where a flight number has been supplied, FEGO monitors the available arrival information. If delays occur after landing, for example at baggage reclaim or immigration, the customer is asked to inform FEGO or the chauffeur.
5.3 Significant delay or flight cancellation. If there are significant flight changes, particularly a delay of more than two hours or a cancelled flight, FEGO and the customer coordinate the next steps. Depending on availability, options may include an adjusted collection, another suitable vehicle or a mutually agreed rebooking. Unlimited vehicle availability cannot be promised. However, a flight delay does not automatically end the booking and is not in itself treated as a cancellation. Additional charges require a contractual basis; a cancellation by the customer is governed by clause 8, while other service disruptions are governed by clause 10 and statutory provisions.
5.4 Chargeable additional waiting time. Waiting beyond the included period and additionally agreed stops are charged at the waiting rate stated in the quotation for each commenced 30-minute period. Charging starts only after the complimentary waiting time ends. For example, 20 minutes of additional waiting count as one billing unit, and 40 minutes count as two units. The price agreed in advance for that unit applies. Waiting caused by FEGO is not charged additionally. Expiry of the complimentary waiting time does not automatically end the booking.
5.5 Time calculation for hourly and multi-day bookings. For hourly bookings, the start and end stated in the quotation apply. Complimentary transfer waiting times do not extend an hourly booking. Any extension is agreed with FEGO and charged at the agreed additional rate. Applicable statutory driving, rest and working time rules must be observed; FEGO plans any necessary chauffeur changes. A multi-day booking provides continuous availability around the clock only if this has been expressly agreed and organised accordingly.
6. Additional services and expenses
6.1 Prior agreement. Additional services and expenses are charged only if their payment has been agreed in advance. Where they can be anticipated when the contract is formed, FEGO states the price or its basis of calculation in the quotation. This applies in particular to additional stops, special equipment and necessary expenses.
6.2 Parking charges and tolls. Agreed parking charges and tolls that are not already included in the fare are charged at the actual amount incurred and shown transparently. Fees already included in the quotation price are not charged again.
6.3 Child seats. Requested child seats cost €20.00 including VAT per seat and day of service. The quotation specifies the number of seats and service days. The same seat is not charged again for each individual transfer within the same agreed day of service. The customer provides the requirements and the information about the child needed to select a suitable seat in good time. Legally required restraints are a prerequisite for transport.
6.4 Chauffeur accommodation. Necessary chauffeur accommodation is charged at €145.00 including VAT per night and chauffeur, unless a different price was expressly agreed before the contract was formed. The quotation specifies the number of chauffeurs and overnight stays. No additional hotel costs for the same overnight stay are charged alongside this flat rate unless a different arrangement has been expressly agreed.
6.5 Tips. Tips are voluntary and are not part of the agreed fare.
7. Payment, card authorisation and invoicing
7.1 Payment methods and due dates. The payment method and due date are stated in the quotation. Visa, Mastercard and American Express card payments may be made through the payment link provided by the payment service provider Stripe. Bank transfer is possible by arrangement. If no card security arrangement has been agreed, payment is generally due in advance on the date stated in the quotation. Payment against invoice or other payment terms may be agreed separately.
7.2 Reserving an amount on a card. If agreed in the quotation and technically supported, FEGO may pre-authorise the agreed total amount plus a 10% security reserve on the card. This reserves an amount; the reservation alone does not create an additional fee. It may temporarily reduce the card’s available spending limit. It authorises FEGO to charge only amounts actually owed under the contract and does not permit charges for additional services that were not agreed.
7.3 Renewal and release of the authorisation. If an agreed pre-authorisation expires before the journey, FEGO informs the customer of any necessary renewal. Renewal takes place within the authorisation granted and the payment service provider’s requirements; fresh consent is obtained where required. Authorisations no longer needed are submitted for release without undue delay after final settlement. When the amount becomes available again also depends on the card-issuing bank.
7.4 Invoice and final settlement. After the service, the customer receives a final invoice. Agreed additional services, additional waiting time and expenses are itemised transparently. Payments already made are credited, and any excess amounts not owed are refunded without undue delay. Invoices are sent in the legally required or otherwise permitted format, including a structured electronic invoice where applicable. Where consent is required for electronic delivery, it is obtained.
7.5 Late payment. Statutory provisions apply to late payment. These terms do not waive statutory requirements for default, any necessary payment reminder or the setting of a deadline.
8. Cancellation, partial cancellation and no-show
8.1 Free cancellation at least 72 hours beforehand. Cancellation is free of charge if FEGO receives it at least 72 hours before the agreed start of the journey. This applies regardless of vehicle size. The deadline is calculated in hours: for example, if the journey starts at 10:00 on Friday, FEGO must receive the cancellation by 10:00 on Tuesday at the latest. Receipt by FEGO is decisive.
8.2 How to cancel. Cancellation may be declared in text form, in particular by email to info@fego-mobility.de. The customer should provide the booking number or journey details so that the booking can be identified. A cancellation that can clearly be matched to a booking is not invalid solely because no booking number was provided. Its validity does not depend on a separate acknowledgement by FEGO.
8.3 Later cancellation. For a later cancellation, FEGO may, to the extent permitted by law, claim the agreed remuneration for the cancelled service. However, saved expenses and income from alternative use of the capacity made available are deducted. Alternative earnings that FEGO deliberately fails to obtain in bad faith must also be deducted. FEGO explains its calculation transparently. The customer expressly retains the right to demonstrate that no amount or a lower amount is owed. The full booking price is therefore not automatically charged without these deductions.
8.4 Multiple days or vehicles. If a multi-day booking is cancelled in full, the 72-hour deadline is measured from the start of the first day of service. If only individual service days, vehicles or separately agreed journeys are cancelled, the relevant start time of the cancelled service applies. The part of the booking that is still to be performed remains in place. The remaining order is not repriced without agreement solely because of a partial cancellation.
8.5 Failure to appear at the meeting point. If the customer or booked passengers do not appear at the agreed meeting point, FEGO first tries to reach the customer or nominated contact using the contact details provided. Expiry of the complimentary waiting time does not automatically cause the service to be abandoned. FEGO considers the circumstances and, where required, allows a reasonable additional period. Only then is a decision made on the next steps. Claims for remuneration or damages are governed by statutory provisions; saved expenses and alternative earnings are deducted. Amounts already charged cannot be claimed again.
8.6 Special assignments and refunds. Different cancellation conditions may be agreed before the contract is formed for major events, multi-day assignments or other special orders. These are expressly communicated to the customer before booking. Payments already made are credited against valid claims, and any remaining surplus is refunded without undue delay. Statutory rights in the event of a breach by FEGO, non-performance of services and termination for good cause remain unaffected.
9. Customer information, contact person and safety
9.1 Required booking information. The customer provides the information needed to perform the service correctly and in good time. This includes collection and destination addresses, times, passenger numbers, luggage details, a reachable contact person and, for airport collection, the flight number. Special transport requirements, child seats, bulky luggage and the carriage of animals must be coordinated in advance. Statutory rights concerning recognised assistance dogs remain unaffected.
9.2 Customer, passenger and authorised contact. The person placing the order, invoice recipient and passenger may be different people. The agreement made when the contract is formed continues to determine the contractual payment obligation; simply naming another invoice recipient does not change it. The customer may nominate a contact person for the service. Chargeable changes may be ordered only by the customer or someone authorised by them for this purpose. Merely nominating a contact person does not grant unlimited authority to order additional services.
9.3 Safe transport. Transport takes place only within the permitted vehicle capacity and with legally required passenger and luggage restraints. Safety-related instructions from the chauffeur must be followed. Customers cannot require unlawful driving or breaches of applicable driving, rest and working time limits. Smoking and the use of e-cigarettes are prohibited in the vehicles.
9.4 Safety risks, damage and soiling. If there is a specific safety risk, FEGO may refuse or interrupt transport to the extent permitted by law. Where the situation allows, FEGO first seeks to remedy the issue. Statutory provisions apply to culpably caused damage or exceptional soiling. Recoverable cleaning, repair or other costs are supported by clear evidence. Normal signs of use do not give rise to a claim for damages. This clause does not impose blanket liability on the customer for all behaviour of other passengers.
10. Service disruptions and liability
10.1 Information and available solutions. FEGO informs the customer as early as possible of foreseeable disruptions, such as a vehicle breakdown or a significant delay, and coordinates available solutions with them. This may include using a suitable replacement vehicle. If FEGO does not perform a service it owes, that service is not charged and advance payments attributable to it are refunded. Claims arising from cancellation by the customer or a no-show are instead governed by clause 8. Further statutory rights remain unaffected.
10.2 Traffic, weather and connections. Traffic conditions, road closures and weather can affect journey times. FEGO takes foreseeable circumstances into account when planning and communicates significant changes. For time-critical journeys, the customer should provide flight, departure or event times in particular, so that an appropriate collection time can be agreed. This information does not constitute a blanket exclusion of liability for delays or resulting loss.
10.3 Unlimited liability. FEGO has unlimited liability for loss arising from injury to life, body or health and for loss caused intentionally or through gross negligence. Mandatory claims, particularly under the German Road Traffic Act and Product Liability Act, remain unaffected. The same applies in cases of fraudulent concealment and within the scope of any expressly assumed guarantee.
10.4 Slight negligence. For a slightly negligent breach of an essential contractual obligation, liability is limited to loss that was foreseeable when the contract was formed and is typical of the contract. Essential obligations are those whose performance makes proper fulfilment of the contract possible and on which the customer may ordinarily rely, particularly the agreed transport. Liability for slight negligence is otherwise excluded. Unlimited and mandatory liability under clause 10.3 remains unaffected.
10.5 Staff and companies engaged to perform the service. These liability provisions apply correspondingly to claims made directly against FEGO’s legal representatives, employees or other persons engaged to fulfil its obligations. FEGO remains responsible for partner companies it engages. These terms do not restrict statutory claims that cannot validly be limited.
11. No statutory right of withdrawal for passenger transport
The passenger transport contracts governed by these terms do not carry a statutory right of withdrawal under the provisions on distance contracts and contracts concluded away from business premises, pursuant to section 312(2), point 14 of the German Civil Code (BGB). This also applies when such a booking is made by email, telephone or through the website.
This is separate from the contractual cancellation option in clause 8, which remains available. The statement about the right of withdrawal applies exclusively to the passenger transport contracts governed here and is not extended generally to other services offered separately.
12. Privacy, complaints and dispute resolution
12.1 Processing booking data. FEGO’s separate privacy notice explains the processing of personal data, the relevant purposes, legal bases, recipients and data subject rights. It is available in the “Privacy” section of the website and on request. This also covers the necessary involvement of payment service providers and partner companies performing the service. Acceptance of these terms is not consent to email marketing.
12.2 Enquiries and complaints. Enquiries about bookings, performance or invoicing may be sent to info@fego-mobility.de. A booking number and brief description of the issue help us respond promptly. Making a complaint first is not a prerequisite for asserting statutory claims.
12.3 Consumer dispute resolution. FEGO is neither obliged nor willing to participate in dispute resolution proceedings before a consumer conciliation body. Access to the courts remains unaffected. Statutory information duties in an individual dispute remain in place.
13. Applicable law, contract language and final provisions
13.1 Applicable law. The law of the Federal Republic of Germany applies. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of their habitual country of residence.
13.2 Contract language. Contracts may be concluded in German or English. The language version agreed for the individual booking applies. This version contains the English-language terms.
13.3 Jurisdiction. The statutory rules on jurisdiction apply to disputes arising from the contractual relationship.
13.4 Invalid provisions. If a provision of these terms is invalid, the remainder of the contract remains effective in accordance with statutory provisions. Invalid provisions are replaced by the applicable statutory rules.
